Terms of Service

1. Provider and Scope

The app is provided by Philogaia UG (haftungsbeschränkt) (see Legal Notice). These terms apply to the use of the mobile app and all features offered through it.

2. Description of Service

Philogaia is an AI-powered health companion that supports your everyday health decisions — for example through nutrition estimates, a daily health score and personalized recommendations. Features may be developed and changed over time.

3. Not a Medical Service

Philogaia is not a medical device and does not replace medical or nutritional advice. Its content is for general information and health support only and does not constitute a diagnosis, treatment or promise of cure. For health concerns, please consult a qualified professional.

4. Eligibility and Account

Use requires a minimum age of 16. An account is required (e.g. via “Sign in with Apple”). You are responsible for keeping your credentials confidential and for ensuring your information is accurate.

5. User Obligations

You agree not to misuse the app, in particular not to:

• disrupt or manipulate the app or its servers,
• gain unauthorized access to other users’ data,
• upload unlawful or infringing content.

6. AI-Generated Content

Some recommendations are produced using artificial intelligence. Despite careful methods, estimates (e.g. nutritional values from photos) may be inaccurate. They are intended as guidance, not as binding statements of fact.

7. Prices and Subscriptions

Philogaia offers a free 7-day trial with full functionality. After that you can choose one of the following subscriptions. All prices include statutory VAT.

Standard (€4.90/month) and Premium (€12.90/month) are purely digital subscriptions and are processed through the Apple App Store as an in-app purchase. Exclusive (€39.90/month) additionally includes a personal service (a monthly in-person check-in) and is therefore booked and billed via philogaia.com.

Subscriptions renew automatically for the respective term unless cancelled before the end of the period. Subscriptions purchased through the App Store (Standard, Premium) are managed and cancelled in your Apple account’s subscription settings; Apple’s cancellation and refund rules apply there. The Exclusive subscription is cancelled via philogaia.com or the contact channels stated there.

The prices and terms shown at the time of purchase in the app or on philogaia.com are decisive.

For digital content, your right of withdrawal expires once performance has begun with your express consent. The free trial lets you fully evaluate Philogaia before purchasing.

8. Liability

We are liable without limitation for intent and gross negligence and for harm to life, body or health. For ordinary negligence we are liable only for breach of essential contractual obligations and limited to the foreseeable, typical damage. Liability is otherwise excluded.

9. Intellectual Property

All rights in the app, its content and trademarks belong to the provider or its licensors. Content you upload remains yours; you grant us the right to process it to provide the services.

10. Term and Termination

You can delete your account in the app at any time. We may terminate the relationship for good cause, in particular for material breaches of these terms.

11. Changes to These Terms

We may adjust these terms, e.g. for new features or legal changes. We will inform you of material changes in an appropriate manner.

12. Governing Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of residence remain unaffected.
